A Stamford divorce follows Connecticut law and is handled through the Stamford-Norwalk Judicial District. It often begins with the serving and filing of divorce paperwork. Then, there is a “discovery” process, during which financial information is exchanged, before a negotiation occurs to reach agreement. Mediation, collaborative law and litigation all provide frameworks for this to occur. Most cases settle without a trial, and reach a complete agreement that a judge can approve as your final judgment. If an agreement is not reached, then the matter proceeds to trial, after which a judge will decide the outcome.
Connecticut courts decide custody based on the best interests of the child, considering factors such as each parent’s relationship with the child, the child’s needs, and each parent’s ability to meet them. Many, if not most Stamford area parents resolve custody through a negotiated parenting plan, achieved through mediation or a collaborative law divorce approach, rather than leaving the decision to a judge.
Connecticut is an all-property equitable-distribution state. General Statutes § 46b-81 requires the court to consider many factors for divorcing Stamford (and all) couples: “the length of the marriage, the causes for the annulment, dissolution of the marriage or legal separation, the age, health, station, occupation, amount and sources of income, earning capacity, vocational skills, education, employability, estate, liabilities and needs of each of the parties and the opportunity of each for future acquisition of capital assets and income. The court shall also consider the contribution of each of the parties in the acquisition, preservation or appreciation in value of their respective estates.” Sometimes, valuation and/or taxation experts are used to assist with this process.
Even an amicable divorce should have a properly drafted Separation Agreement. Having an experienced attorney prepare or review that agreement helps ensure it is complete, enforceable, and protects your long-term interests, so a friendly resolution today does not become a costly dispute later.
Divorce is challenging, but with the right legal guidance, it can also be a turning point for growth and peace of mind.
